HC warns Govt on transgenders rights

Srinagar, June 6: High Court today warned Government with stern action for not preparing and finalizing the policy on providing constitutional rights to the transgernders in the State.
The Division Bench of Justice Ali Mohammad Magrey and Justice D S Thakur rapped the Government with serious observations and directed to finalize the policy positively by next date.
Counsel representing Social Welfare Department submitted before the Court that that the policy has been submitted to Law Department and it is the Law Department who has to give final call in the matter.
Court directed the Law Department to positively respond to the policy and also directed the SWD to finalize the same thereafter as four months have lapsed but the matter is as it was, which reflects the casual approach of both SWD and Law Department.
Court recorded that before proceeding against Commissioner Secretaries of Law as well as Social Welfare Departments, they are given one more chance to finalize the policy and in default they both be present before the Court on next date.
Earlier, a copy of the draft policy along with the response affidavit was placed before the court.
Petitioner had submitted that the draft policy is not consistent with the direction issued by the Supreme Court and consequently he was permitted by the Court to submit his objections to the Law Department.
