HC directs Govt to file status report on deportation of Pak nationals

SRINAGAR, Apr 17: High Court directed Government to file status report within two weeks about the steps taken for the deportation of at least four Pakistani nationals to their native country.
The directions in this regard were passed by the court after hearing separate petitions filed by the foreigners through their counsel Advocate Mir Shafaqat Hussain.
The foreigners including Sarfaraz Ahmad Raina (40) of Karachi, Syed Moinullah Shah (25) of NWEFP, Asif Khan of Pakistan occupied Kashmir and Rubeena (22) of Hyderabad, Pakistan.
Regarding Rubeena, the court also directed SP Kotebalwal Jail, Jammu, to get her medically examined by the doctor. “If the doctor posted in the jail is of the opinion that she needs specialized treatment from any of the leading hospital of the State that may be considered as per the rules,” the court said.
In case of Raina, the court also directed the Government to consider his lodgment in Central Jail Srinagar.
With regard to Shah, the court directed concerned Superintendent of the jail to get him medical examined in accordance with the rules governing the field.
Meanwhile, the court directed Government to inform it about the steps taken regarding two other foreigners-Diloo Mian and Saleh Mohammad-in light of an order issued by Ministry of Home Affairs (Foreigners Division) passed on March 12, 2012.
As per Advocate Shafaqat, the order envisages that all foreign nationals who have completed their sentence but have not been deported due to non-confirmation of their nationality and issues relating to travel documents may be released from jail and be kept at appropriate place outside the jail.
The court directed Third Additional Session Judge Srinagar and Principal Session Judge Baramulla to take trial to logical conclusion expeditiously preferably within six months regarding another foreigner, Waheed Noor Khan, about cases-FIR 33/2010 in Karan Nagar and 410/2010 Sopore police stations.
