File ATR in FIR lodged 3 yrs back: HC to SSP

JAMMU, Aug 6: Division Bench of State High Court comprising Justice Ramalingam Sudkhakar and Justice B S Walia has directed the Senior Superintendent of Police (SSP) Jammu to file Action Taken Report vis-à-vis FIR registered in 2013 at Police Station Nowabad on or before August 29 failing which issue will be viewed very seriously.
The direction has been passed in a petition titled Welfare Association of Shareholders versus State of J&K and Others.
After hearing Advocate R K S Thakur for the Welfare Association of Shareholders, the DB said, “vide order dated October 7, 2015 the court, while taking serious note of dilly-dallying approach of police, had directed for completion of investigation by next date of hearing and filing of charge-sheet before the competent court”.
As nothing happened, the Court on December 2, 2015 had observed that investigation was being protracted beyond all reasonable limits. Accordingly, the High Court while entrusting the investigation to SDPO Bakshi Nagar had directed for filing of status report by next date.
“Even this order has not shown any result except status report dated December 16, 2015 filed by SDPO Bakshi Nagar stating therein that all the best possible efforts will be made to complete the investigation”, DB said, adding “as nothing concrete has happened we are inclined to direct SSP Jammu to take stock of the action taken on the part of the concerned officers”.
“An Action Taken Report will be filed on or before August 29, 2016 by SSP Jammu failing which issue will be viewed very seriously”, the DB said.
