Court denies bail in culpable homicide case

JAMMU, June 10: Judicial Magistrate Samba Shabnam Sheikh has rejected the bail application of one Bhagat Singh, son of Sahil Singh, who had alleged committed offences under Sections 307/304/ 30 Arms Act.
According to the police case, due to old enmity Bhagat Singh entered the house of complainant Sanjay Singh on 16.05.2018 and started beating his father with fists and blows and with the butt of 12 bore rifle. However, when complainant’s mother Kama Devi tried to rescue him then Bhagat Singh also attacked her leading to her death on the spot.
Accordingly, FIR was registered. In his statement, Sanjay Singh turned hostile and stated that her mother died due to fall. Moreover, husband of the deceased also gave the same statement before the court.
After hearing Advocate Ganesh Sharma for the applicant whereas Prosecuting Officer Tanveer Khatana for the State, court observed, “no doubt the individual liberty of every citizen must be avidly safeguarded but nonetheless where a person is accused of a serious offence a balance has to be struck between individual liberty and interest of society at large”.
“In order to maintain the faith of public in judicial system it is important to see that a person/accused of serious offence should not remain at large. At the time of granting or refusing bail, this court cannot go into the merits of the case but has to see the effect of releasing the accused person on the course of investigation, his tendency to tamper with the prosecution evidence, his tendency to flee”, the court said, adding “in the present case the accused person is alleged to have committed offence under Sections 304/307 RPC, which itself is a serious offence against the society at large”.
“The investigation of the case is in progress and the release of accused at this stage will be prejudice to the prosecution case”, the court said while rejecting the bail application.
