SWD Secy has poor understanding of JJ Act: DB

Srinagar, Sept 5: High Court today came down heavily on Commissioner Secretary Social Welfare Department and observed that he has poor understanding of Juvenile Justice Act and its Rules.
After perusal of the status report of Commissioner Secretary SWD, High Court returned the same and said the same is inadequate and does not address the issues and concerns in terms of Juvenile Justice (Protection and  Care of Children) Act and its Rules.
High Court on last date also had said the affidavit filed does not specify the requirements envisaged in Juvenile Justice Act for orphanages and directed for filing of fresh affidavit indicating there-in the plan of action to meet all deficiencies.
Today when the fresh affidavit was placed before the Division Bench of Chief Justice Badar Durrez Ahmad and Justice Ali Mohammad, the same was out-rightly rejected and returned. The DB granted final two weeks for overcoming the deficiencies.
DB said that once the Act has been in place and the Rules made thereunder, then Government cannot take excuse of non-availability of funds.
Even on last date of hearing Commissioner Secretary (SWD) was taken to task by the court for his failure to appear before it.
Court had directed the Commissioner Secretary to file his affidavit by next date indicating there-in the action of plan to meet the deficiencies in Orphanage homes across the State. But the affidavit was found unsatisfactory.
