Judicial Academy organizes refresher course for Munsiffs on Code of Civil Procedure

JAMMU, Mar 29: : Under the guidance and patronage of Chief Patron of State Judicial Academy, Justice N. Paul Vasanthakumar, Chief Justice, High Court of Jammu and Kashmir, State Judicial Academy today conducted one day refresher course for Munsiffs of Jammu province on Code of Civil Procedure and Evidence Act at Judicial Academy here.
Justice Muzaffar Hussain Attar, Chairman, State Judicial Academy presided over the programme. He interacted with the Judicial Officers and advised them to get benefit of the vast experience of Resource person Justice (Retd.) O.P. Sharma who had been not only a great judge but also a great jurist in all fields of law.
The programme was conducted by Pawan Dev Kotwal, Director, State Judicial Academy.
Justice Sharma dealt with all the topics of the programme. He  exhaustively explained the provisions of Orders XX, XXII, XXIII XXVII, XXIX, XXX, XXXIII, XXXVII and Order XXXIX of the Code of Civil Procedure and their practical application in the first two sessions i.e. Judgment and Decree, Abatement of suits,  Withdrawal and Adjustment of suits, Suits by or against the Government or public officers in the official capacity, Suits by or against corporations, Suits by or against Firms and persons carrying on business in names other than their own, Suits by indigent persons, Summary procedure, Temporary Injunctions and Interlocutory orders.
In the last session, Resource person dealt with Sections 45, 73 and Sections 65, 65-A, 65-B of the Evidence Act and enlightened the participants about the relevance of opinions of experts, comparison of signature, writing or seal with others admitted or proved, cases in which secondary evidence, special provisions as to evidence relating to electronic record in civil and criminal cases.
Justice Muzaffar Hussain Attar also dealt with many provisions of law and queries raised by the participants and advised them to work hard for the interests of litigants in particular and social order in general. He also enlightened the Judicial Officers about the values and qualities which every judge should possess.
