HC’s directives in petitions challenging qualification of 40 Incharge Lecturers

JAMMU, Oct 17: In the petitions challenging the qualification of more than 40 Incharge Lecturers, who were adjusted in School Education Department, Justice Dheeraj Singh Thakur has issued various directions to the State respondents and made it clear that in case of failure to ensure compliance Commissioner Secretary Education Department shall appear before the court in person.
When the petitions came up for hearing, Additional Advocate General Seema Shekhar submitted that a status report has been filed. “A detailed information has been received as also validity of degrees/qualifications obtained through Distance Mode in regard to 16 private respondents. It is also reflected that so far as six respondents are concerned, they have obtained the qualification through regular mode from the recognized universities. However, as far as five private respondents are concerned the requisite information is awaited from the concerned institutions”, she said, adding “even in case of five other private respondents the requisite information has not been received either from the respondents or from the Director School Education”.
After hearing Senior Advocate B S Salathia with Advocate Ashish Sharma appearing for the petitioners whereas Additional Advocate General Seema Shekhar for the Education Department, Senior Advocate Surinder Kour assisted by Advocate Davinderpreet Kour for the private respondents, High Court directed the State respondents to take decision in case of those whose information has already been received by the official respondents by or before October 28.
“The copy of the decision shall be placed before the Court on October 28, 2013 failing which Commissioner Secretary Education Department shall remain present in person”, High Court said.
