HC directs implementation of its directions on coaching centres

Srinagar, Nov 20: The High Court today directed the authorities to implement the directions of Court with regard to running and operating coaching and tuition centers and ensure these centers do run in tune with the regulations governing the field.
These directions followed after the Court was informed that despite various directions from the Court, there is no proper check of illegal coaching, no student ratio, no fee structure revealed by the coaching centers as also unabated unregistered coaching centers are existing day by day.
After these submissions made by counsel appearing in the PIL, the Division Bench of Justice Ali Mohammad Magrey and Justice Sanjeev Kumar directed all the concerned authorities to implement the directions of the Court and regulate the proper running of all the registered coaching and tuition centers in the State.
Court also directed the Division Commissioner Jammu to file the status report as directed. He has to file the status report after receiving of inspection report of Judges’ committee for taking necessary remedial measures about the issue of unregistered centers.
The PIL sought directions for closing down of all illegal and unregistered private tuition Centers across the Valley. Subsequently, the Court formed a high level panel asking it to close down all the unregistered coaching centers.  Later directions were issued for Jammu division also.
The PIL also sought cancellation of registration of private tuition centres who do not conform to the rules in vague, particularly displaying and notifying monthly tuition fee or charge exorbitant tuition fee.
It may be mentioned that Court has already constituted three-member committee headed by Divisional Commissioner Kashmir with Director School Education and Inspector General of Police, Kashmir, as its members. The said committee was asked to immediately close down all unregistered tuition and coaching centers wherever functioning in Kashmir Division. The Court today after being provided details of ground situation by the counsel directed all the authorities to implement all the directions passed from time to time in letter and spirit.
Court has also been informed that since long the Judge’s committee has not filed their report before the Court. The said committee was directed to inspect all the coaching /tuition centers and find out as to whether the undertakings given in the Court are correct and whether they (coaching centers) have compiled with the J&K Regulation of Private Tuition Centers Rules of 2010.
In order to secure the interests of children who are studying in the unregistered coaching and tuition centers, the Court had directed the owners and the authorized persons of the institutes not to operate their bank accounts which stand on their names.
A similar committee (comprising Divisional Commissioner, Direction School Education and IGP) for Jammu Division shall stand constituted as has been constituted in Kashmir Division and all the directions issued with regard to Kashmir Division have been extended to the said committee.
The coaching and tuition centers functioning in Jammu, Court had said, shall file undertakings that they comply with 2010 Rules and Court directions before the Divisional Commissioner Jammu, who was asked to notify the order to all the coaching and tuition centers operating in the division.
