DB stays SHRC orders passed against AAI

JAMMU, Mar 5:  Division Bench of the State High Court comprising Chief Justice Badar Durrez Ahmed and Justice Sanjeev Kumar has stayed the orders passed by State Human Rights Commission (SHRC) against Airport Authority of India on May 29, 2017 and December 11, 2017.
In the petition filed by Airport Authority of India challenging the suo-moto cognizance of the SHRC, it has been submitted that at the airports of Jammu and Srinagar, some restaurants and at some public outlets the packaged commodities (food items etc) are being sold at the price more than MRP and also declaring dual MRP on the same packaged commodities.
“This practice is done at large, which is violation of Legal Metrology Packaged Commodities Rules, 2011 and the Legal Metrology Act, 2009. The public is being charged at higher rates thus putting them at huge monitory losses. This is being done under the nose of higher officers and within the knowledge of the officers at the helm of affairs”, the petition said.
During the course of hearing Advocate Inderjeet Gupta submitted that Commission has no jurisdiction to entertain such type of complaints because Section 2(c) of the Human Rights Act states that human rights means the rights relating to life, liberty, equality and dignity of the individual guaranteed by the Constitution or embodied in the International Covenants and enforceable by the courts in India.
It was further submitted that SHRC has no jurisdiction to pass directions for conducting enquiry by SSP Airport Jammu /Srinagar.
After hearing Advocate Inderjeet Gupta for the Airport Authority of India, DB issued notice and ordered that there shall be stay of operation of the orders dated 29.05.2017 & 11.12.2017 passed by the State Human Rights Commission.
