DB directs VC JDA to remain present along with Rs 25,000 cost

JAMMU, Sept 2: Division Bench of State High Court comprising Justice Virender Singh and Justice Tashi Rabstan today took serious note of the non-implementation of order dated November 10, 2009 by virtue of the which the Jammu Development Authority had been directed to demolish the commercial complex within two years.
The DB now directed Vice Chairperson JDA to remain present in the court on the next date of hearing along with Rs 25,000 cost imposed in terms of order dated March 27, 2013 otherwise the court would take very harsh view in the matter.
The direction was passed in an application filed by VC JDA seeking extension of time, clarification and modification of the directions regarding deposit of imposed cost. Advocate SK Shukla opposed the application and stated that Vide order dated March 27, 2014 last opportunity was granted to JDA to take all required steps for modification of lay out plan of Roop Nagar, Housing Colony.
He further stated that even the last opportunity was subject to the payment of cost of Rs 25000 to be deposited by VC JDA, adding vide court order, the Vice Chairman shall not debit the account of the JDA but shall pay the costs from personal pocket.
After hearing Advocate SK Shukla in length, Division Bench dismissed the application filed by VC JDA and directed that VC JDA shall remain present in the court on next date of hearing along with costs of Rs 25,000.
