Court rejects anticipatory bail plea

JAMMU, May 1: Ist Additional Sessions Judge Jammu, M A Chowdhary has denied anticipatory bail to three persons, who were allegedly involved in theft of sacred statue and ornaments from the Kul Devi Shilawanti Sajawati maintained by Abrol Biradari in Akhnoor tehsil.
As per police report, Ashok Mishra, Naresh Mishra and Raman Mishra, all sons of Jagan Nath Mishra, residents of Ward No.4 of Chougan Mohalla Akhnoor were booked under FIR No.50/2016 for the commission of offences punishable under Sections 457, 380 and 295 RPC on the ground that on the intervening night of March 22 and 23, 2016 they entered into the premises of a religious place and decamped with scared statue and ornaments.
After hearing the counsels for both the sides, the court observed, “the allegations against the accused are very serious and the bail in anticipation of arrest cannot be granted”, adding “the accused have failed to make out a case to exercise the discretion of granting bail enshrined in Section 497-A CrPC”.
With these observations, the court rejected the bail application and revoked the interim bail granted vide order dated March 26, 2016.
