Court issues non-bailable warrant against SSP, Srinagar

SRINAGAR: Chief Judicial Magistrate, Srinagar has issued non-bailable warrant against Senior Superintendent of Police (SSP), Srinagar for failing to register FIR against a police officer allegedly involved in killing a youth inside his house on the city outskirts recently.

CJM Masarat Shaheen while rejecting  the application of SSP seeking exemption from personal appearance, issued non-bailable warrant against him for failing to register FIR against Deputy Superintendent of Police (Dy SP) Yasir Qadri as directed by the court earlier.

The police officer is accused to have killed a youth Shabir Ahmad Mir inside his house at Bypass Tengpora when there were some protests on the main road. The court directed Deputy Inspector General (DIG) Central Kashmir to execute the order.

The prosecution while defending the police official informed the court that the police has already lodged an FIR under sections 1479 rioting), 148 (rioting armed with deadly weapon), 307 (attempt to murder), 436 (Mischief by fire or explosive substance) and 152 RPC (Assaulting or obstructing public servant when suppressing riot) RPC, in which the deceased youth has been named as accused.          Police also alleged that Shabir was leading a procession on the day he was killed.

However, the parents of the youth alleged that Shabir was shot dead by the DySP from point blank range inside their house. Rejecting the police argument, the CJM directed SSP Srinagar Amit Kumar on Thursday to lodge the second FIR against accused DySP and file the copy of the FIR before the court within 24 hours.

However, the SSP has not filed FIR against the police officer and instead sought exemption from personal appearance. (AGENCIES)
