Court denies bail to HM terrorists

JAMMU, Feb 7: Sub-Judge/Judicial Magistrate Ist Class Chadoora Rajesh Kumar ID Abrol has denied bail to two militants of Hizbul Mujahideen outfit.
According to the prosecution case, the militants namely Younis Bashir of Checkpora and Adil Ahmed of Lasjan were arrested under Sections 419, 506, 387, 511 and 120B RPC at Police Station Nowgam on the basis of the complaint filed by Mohammad Amin Bhat of Checkpora.
These militants were demanding Rs five lakh from the complainant for Hizbul Mujahideen outfit with the warning that he and his family will face the consequences of death if the complainant failed to follow their directive.
After hearing Prosecuting Officer and counsel for the accused persons, Sub-Judge/JMIC Chadoora observed, “the allegations against the accused persons are very serious in nature and they seem to be linked with Hizbul Mujahideen terrorist organization, which is presently very actively operating in Kashmir valley for unlawful killings of innocent persons and security men”.
“The letter issued by the accused persons bears serious threat to the life of the complainant and his family members”, the court said, adding “the concerned police ought to have incorporated Sections 38, 40 and 17 of Unlawful Activities Act but unfortunately they have failed to do so”.
“The alleged offences committed by the accused persons come within the purview of sessions trial and as such this court has got no jurisdiction to even entertain this application for adjudication”, Sub Judge said, adding “the counsel for the applicants/accused could not satisfy the court for grant of bail to the accused persons, who are connected with terrorist organization and are busy in terrorizing the people for raising funds”.
With these observations, court rejected the bail application.
