While rejecting the bail, the court observed, “as per police report, the petitioner was accused of smuggling animals from Punjab to district Kathua in violation of the order of District Magistrate Kathua and a case was registered vide FIR No 80/2017 under Section 188 RPC and 3/5 PCA Act”, adding “since then the petitioner is absconding and has not associated himself with the investigation of the case”.
“Moreover, he has again committed the offence of the similar nature and is required for investigation of the case registered vide FIR No. 200/2017 of the same Police Station.  In view of the allegations with regard to the commission of offence and repeat thereof by the petitioner, in my considered opinion, he is not entitled to be admitted to bail in anticipation of arrest. However, he shall be at liberty to move a regular court for grant of bail in case, he chooses so”, the Principal Sessions Judge said.
