JAMMU, Feb 14: Principal Sessions Judge Kathua, M K Hanjura has acquitted one Dharminder Singh, who was facing trial for committing murder of one Sahil, son of Kuldeep Raj.
After hearing Public Prosecutor Ravi Gupta for the State whereas Advocate Kirty Bhushan for the accused, Principal Sessions Judge observed, “it was on rising from the deep slumber that the wearing apparels of the deceased were sent for chemical analysis after 56 days from the date of occurrence. It creates a huge doubt whether these clothes remain lying unhampered and intact for a period of 56 days. It sows the seeds of suspicion into the entire prosecution case as such the chances of the false implication of the accused cannot be ruled out”.
“A judicial process cannot be issued in the case where the circumstances of the case do not in any way connect the accused with the crime. There is no evidence to show that the accused caused the death of the deceased and the case straightway merits the acquittal of the accused”, the Court said.
Accordingly, the Court acquitted the accused of the charges leveled against him.
