Cop facing trial for killing colleague acquitted

JAMMU, Apr 23: Principal Sessions Judge Bhaderwah has acquitted a police constable Shailender Kumar, son of Om Parkash of Gandoh, who was facing trial for allegedly killing his colleague.
According to the police case, on April 10, 2006, constable Shailender Kumar killed his colleague and later conveyed to the seniors that he (deceased) was killed in militant attack on Kota Police Picket.
During the course of investigation, it was found that the accused was in-charge of Police Picket Kota and he killed his colleague over an old enmity.
After hearing both the sides, Principal Sessions Judge Bhaderwah M K Sharma observed, “the investigation has been done in a reckless manner. As a corollary to this, it is further clear that the investigation was neither fair nor honest in this case”.
“The FIR was lodged on April 10, 2006 at 8.15 pm. In the ordinary course of things under Section 157 CrPC police was required to send a copy of the FIR to the Magistrate expeditiously. Unfortunately, copy of FIR was sent to the Magistrate on April 12, 2006. This further goes to show the cursory and casual manner in which the investigation was undertaken”, the Court said
With these observations, Court observed that the prosecution has miserably failed to prove its case. Accordingly, the accused was acquitted of the charges leveled against him.
