BCC doesn’t has any relevance for real OBCs: AIBCU

JAMMU, Jan 9: The present system of Backward Classes Commission (BCC), whether functioning or not does not has any relevance for the real State Backward Classes called Other Social Castes (OSCs) in J&K.
This was expressed today by All India Backward Classes Union (Social) during a meeting held here today under the chairmanship of its president, MR Bangotra, Prof Kali Dass, and many others.
While speaking on the occasion, members said that after the Apex Court’s Judgment of 1992 on Mandal Report, every State had to set up a “State Backward Classes Commission” but JK Government did not do the same and did so in 1995 after three years. But the Government cheated the real OBCs by including ALC and RBA people in OSC category and providing them 20% and 3% reservation from OSCs’ 27% share.
“Government is authorized to grant reservation to any group of people but it cannot make vertical distribution which has been done in J&K in violation of Para 95 of the Apex Court’s Judgment of 1992 which speaks of “Horizontal Reservation” under Art 16(1) of the Indian constitution”, the members said, adding, they have represented their case many a times but till date results are awaited.
They further criticized the successive State Governments for not appointing any person from OBCs as chairperson of the State Backward Classes Commission. “Appointment of Non-OBC Chairman services two purposes— one to please the chairman with lucrative benefits and other is to stop the natural flow of justice to the real OBCs”, they alleged.
The meeting appealed the State Government to disassociate the RBA/ALC from the Backward Classes Commission and constitute a separate committee for these two categories after adjusting their due share horizontally, the only viable and magic solution under rule.
