10 convicted, 28 acquitted in mosque attack case

JAMMU, June 29: Principal Sessions Judge Kulgam, Subash C Gupta today convicted 10 accused under Section 304-I (culpable homicide not amount to murder) and acquitted 28 accused in the much publicized Kelam Jamia Masjid attack case.
Those who have been convicted are Ab Razak Parrey, son of Gh Ahmad, Aziz Bhat, son of Qadir, Jalil Bhat, son of Qadir, Manzor Bhat, son of Aziz, Sartaj Bhat, son of Aziz, Syed Bhat, son of Habib, Dawod Padder, son of Mohi ud Din, Showkat Bhat, son of Majid, Bashir Ahmad Bhat, son of Gani and Gani Bhat, son of Qadir.
The court directed that the accused be sent to Central Jail and shall be produced on June 30 for pronouncement of quantum of punishment.
These accused were involved in causing injuries to numerous people by attacking them with stones and sticks outside a mosque on September 19, 2009 over a dispute relating to Idgah land.
After hearing both the sides, Principal Sessions Judge observed, “it can safely be held that prosecution has succeeded in proving the guilt of the accused for commission of offence of culpable homicide not amount to murder punishable in terms of provisions of Section 304 Part-I, read with Section 149 of RPC beyond all shadows of doubt”.
“Moreover, they are also found liable for commission of offence under Section 323 read with 149 of RPC beyond all shadows of doubt. Accordingly, they are convicted. However, evidence is lacking to prove commission of other offences under Sections 148,336,325,341 & 302 of RPC, as such, they are acquitted for these offences”, the court said.
The court also observed that prosecution has miserably failed to bring home the guilt against 28 others. Accordingly, they were acquitted.
