One yr imprisonment awarded in cheque bounce case

JAMMU, Nov 3: Special Municipal Magistrate Jammu Manoj Parihar has awarded one year imprisonment and fine of Rs 7.40 lakh to one Bal Krishan Sharma in a cheque bounce case.
In order to discharge his liability, the accused issued two cheques for Rs 4 lakh and Rs 3.40 lakh both drawn on Central Bank of India, Talab Tillo Branch Jammu. However, these cheques could not be en-cashed on their presentation and the same were returned with the remarks “exceeds arrangement” issued by the concerned bank.
Statutory notice was issued by the complainant through his Advocate requesting the accused to pay this amount within a period mentioned in the statute. On his failure to make the payment, the complaint was filed before the court under Section 138 of the Negotiable Instruments Act.
After hearing both the sides, the court convicted the accused for the commission of offence under Section 138 of Negotiable Instruments Act and awarded him simple imprisonment of one year.
