Life imprisonment awarded to advocate in murder case

JAMMU, Mar 16: Principal Sessions Judge Rajouri Inder Singh has awarded life-imprisonment to an advocate in a murder case.
According to the prosecution case, on January 28, 2013 Police Station Rajouri received an information that Imtiyaz Ahmed, son of Mohd Ashraf of Ward No.7 Rajouri with the intention to kill Tahir Khan, son of Mohd Mushtaq and his fiancée Lubna Kouser, daughter of Mohd Afzal hit their motorcycle from behind by a vehicle resulting into critical injuries to both.
Upon this information, a case was registered for offence under Section 307 RPC and investigation started. In the meanwhile, injured Tahir Khan succumbed to injuries while being shifted to hospital as a result of which Section 302 RPC was added in the FIR.
During the course of investigation, it came to the fore that accused Imtiyaz Ahmed, who was an advocate by profession and advising Lubna Kouser in connection with a case in which her father and brothers were in jail, was compelling Lubna Kouser for marriage. However, Lubna Kouser was opposed to his offer and in the meanwhile engagement of Lubna Kouser was settled with Tahir Khan and this was the ground behind the incident took place on January 28, 2013.
After completion of investigation challan was presented in the court of Chief Judicial Magistrate Rajouri for judicial determination. Since the offence under Section 302/307 RPC was exclusively triable by the court of Sessions Court as such the case was committed to Principal Sessions Judge Rajouri.
After hearing Public Prosecutor and counsel for the accused, Principal Sessions Judge Rajouri Inder Singh observed, “the court is of the considered view that the accused has committed the incident with the intention to cause death of Tahir Khan and Lubna Kouser”, adding “thus he is held guilty of murder of Tahir Khan and accordingly convicted for the commission of offence under Section 302 RPC”.
“The accused is also convicted for the offence under Section 307 RPC for making murderous attack on Lubna Kouser”, the court said and awarded life imprisonment.
