Life imprisonment awarded to 4 in murder case

POONCH, July 16: Principal  Sessions  Judge  Poonch  Tahir Khurshid  Raina  today  awarded  life imprisonment  to  four accused  for committing murder of a young  man  Omar Sharief, son of Mohd Sharief  of Mendhar  in the year 2009.
The accused persons are Abdul Hamid, his  wife Anwar Begum,  their  son  Aiyaz Ahmed  and his  friend  Mustafa  Aziz, all residents  of  Glutta  tehsil  Mendhar.
According to the prosecution case, on June 26, 2009 deceased was on his way to home in the evening when all the accused persons attacked him with iron rods and other objections over an old enmity. The victim survived attack for 12 days and thereafter died when he was being shifted to Jammu from Poonch for treatment in Government Medical College & Hospital.
Entire prosecution evidence which comprises eye witness account, dying declaration and medical evidence  fully confirmed  the prosecution  story  before the court.
The entire incriminating  evidence  was put  to  the accused but  they  failed  to give any  cogent  and convincing  explanation  to it.
After hearing both the sides and taking into account whole gamut of evidence and on the basis of settled legal principles, Principal Sessions Judge Poonch convicted all the accused persons  for  the  offence of murder.
Taking into account  all the mitigating  factors  of  all the  accused, court  observed, “this  murder does not fall in the rarest of rare category”. Accordingly, court awarded life imprisonment to  all the  accused persons with a fine of Rs 5000 each.
