DB declines to treat petition on toll tax as PIL

JAMMU, Dec 18: Division Bench of State High Court comprising Chief Justice Badar Durrez Ahmed and Justice Sanjeev Kumar has declined to treat petition filed by Rajesh Gupta, President Traders Federation Ware House/ Nehru Market on toll tax as Public Interest Litigation.
After hearing Senior Advocate Sunil Sethi appearing for the PIL, the DB observed, “the present petition cannot be treated as a PIL as the petitioner being the President of the Traders Federation Ware House/ Nehru Market is vitally interested in the matter”.
Upon this, Senior Advocate Sunil Sethi submitted that he will add an individual also, who is affected and is vitally interested in the matter and an appropriate application shall be moved within a day.
Division Bench directed Registry to list the petition on December 20.
