Court awards 25 years rigorous imprisonment, fine in forgery case

JAMMU, July 29: 1st Additional Sessions Judge Jammu MA Chowdhary today awarded twenty five years imprisonment and fine Rs 50,000 to Rajbir Singh for the offences u/s 420/467/468/471/120-B RPC.
According to the crime branch case one Thakra Singh S/o Tabeet Singh R/o Gurha Slathia Mandi Bagh Tehsil Samba, moved a written complaint under Sections 420/467/468/406 and 120 RPC, on April 7, 2005, asserting therein that he being an army personal became member of the Sainik House Building Society Sainik Colony, Jammu under Registration No. 5030 and 7939 respectively for allotment of residential plot and shop site in the colony and in response to the application and registration he was allotted plot No. 88-F and shop site GS-246 in Sainik Colony Jammu and he had paid premium/price to the Society in respect of the plot and shop site against receipts no. 9043 dated 28.12.1994 and 9056 dated 09.01.2015 ; that the Chairman and other officials of the Society assured him that all the formalities shall be completed and that as and when his presence shall be required for execution and registration of the lease documents, he shall be informed. The accused hatched a conspiracy and transferred the aforesaid plot and shop site in the name of accused by forging the documents. On this complaint, a case came to be registered at Police Station Crime Branch Jammu, vide FIR No. 29/2006, however, during investigation, Secretary of the Society namely Pritam Singh, who was also involved in preparing forged transfer documents regarding plot and shop site expired and after investigation of the case, the instant chargesheet was laid against Rajbir Singh S/o Prithvi Singh R/o Gurha Slathia Samba and Nanak Singh S/o Chatar Singh R/o Colonel Colony Airport, Jammu, Chairman of the Society (hereinafter called ‘accused’) for the commission of offences punishable under Sections 420/467/468/ 471 RPC.
1st Additional Sessions Judge Jammu MA Chowdhary after hearing APP Ajay Singh Manhas for the State whereas Advocate ML Gupta for the accused observed that Convict had cheated a soldier of this country who had devoted whole of his life for security and sovereignty of this Nation, taking advantage of his simplicity and breached his trust which he had reposed in him by showing him as nominee at the time of allotment of plot. Convict had also been facilitated in his nefarious design in forging documents on behalf of complainant, under a criminal conspiracy by the functionaries of Sainik Co-operative Society, but unfortunately the Chairman Nagar Singh died during trial whereas Secretary Pritam Singh had died during investigation of the case and awarded imprisonment for a term of five years and fine of Rs.10,000/- for the commission of each of the offences punishable under Sections 420, 467, 468, 471 and 120-B RPC (total 25 years imprisonment and fine of Rs.50,000. All the substantive sentences of the imprisonment shall run concurrently.
