The concept of affidavits though reduced to great extent by the Government some time back is still unfortunately in vogue in some departments who not only insist on affidavits but also on its being sworn before a Ist Class judicial magistrate, notwithstanding the facts the institution of Oath Commissioner and Notaries have been created for this purpose. It is strange while Hon’ble Courts accept affidavits attested by Notaries/Oath Commissioners but law ignorant officers of various departments do not. It is high time that the authorities issue orders in this regard also.
Needless to say that false affidavit sworn before a magistrate or Oath Commissioner attract same punishment under Law as experts opine..
But, most respectfully, will anybody listen is a million dollar question.
