Prosecution failure leads to acquittal of charas smuggler

JAMMU, Oct 12: Principal Sessions Judge Poonch Jaffer Hussain Beigh has acquitted Abdul Hamied, son of Abdul Rahim of Thanamandi Rajouri, who was facing trial in NDPS case, as prosecution failed to prove the case.
The smuggler was arrested by Surankote Police on April 25, 2010 along with 900 gram of charas. Accordingly, he was booked under 8/20 NDPS and after completion of the investigation challan was presented in the court of Sessions Judge Poonch.
After hearing Public Prosecutor Ch Nayaz Ali for the State whereas Mohd Showket Amin Manhas for the accused, Principal Sessions Judge observed, “all the prosecution witnesses examined in the instant case are police officials and the single civil witness examined by the prosecution has not supported the prosecution at all. There was a number of people on spot but no independent witness was called”.
“It is thus evident that public witnesses were available and could have been associated to witness the search and recovery. Even those persons who had seen the recovery as per one of the prosecution witness have not been cited or examined by the prosecution and no explanation on these lines is forth coming which also make the prosecution case doubtful”, the court said.
With these observations, Court acquitted the accused of the charges leveled against him.
