HC directs for continuation of doctor on Demonstrator post

Srinagar, June 24: As the Government in view of surge in COVID-19 cases extended the tenure of doctors who are going to retire in near future by ending December, the SKIMS has contemplated to retire such doctors and the High Court in this regard while dealing with a case directed the doctor working as demonstrator be allowed to continue on the post.
The petitioner-Dr Ashaq-Ullah Bhat was appointed as Demonstrator for a period of two years in SKIMS in June 2015 and in January 2021 sanction was accorded to the extension of his tenure for a period of six months, from March 2021 or till new selection is made on his retirement.
In the meantime, Government of Jammu and Kashmir vide order No.358-JK(HME) of 2021 dated 04.05.2021, has ordered that services of Faculty Members/ Consultants/Doctors, working in SKIMS, Soura and Bemina Government Medical Colleges and Health Department, who are going to retire from May 2021 to November 2021, are extended up to 31st December 202.
The case of petitioner-Bhat is that despite sanction granted to his extension for a period of six months w.e.f. 10.03.2021 in terms of order dated 04.05.2021, issued by Financial Commissioner, Health & Medical Education Department and notice issued by Registrar Academic, his services are being dispensed and is aggrieved of the action of authorities of SKIMS and submits that he is entitled to remain as Demonstrator till 31.12.2021 in terms of Government order.
Justice Vinod Chatterji Koul issued notice to the authorities for their reply. SKIMS counsel Shah Aamir (AAG) accepted notice in open court on behalf of SKIMS. Court in the meantime, subject to objections and till next date of hearing before the Bench, directed that the petitioner-Bhat shall be allowed to continue on the post of Demonstrator at his own risk and responsibility till next date before the bench.
