JAMMU, Aug 26: Disposing off two cases of deaths in militancy related incidents, the J&K State Human Rights Commission Member Jang Bahadur Singh Jamwal has recommended to the J&K Government that Rs 5 lakh be provided to next of kin in both the cases.
The recommendation was made in the case titled Ab Rerman Akhoon of Simna Colony Kishtwar v/s State regarding son of the applicant namely Late Bashir Ahmad who was killed in militancy related incident in Chichha (Nagsani) and the case titled Gh Mohd Bhat of Dhandhal Dhar, Kastigarh, Doda v/s State & others, wherein daughter of the complainant namely Mumtaz Banoo was abducted by the militants and her whereabouts were not known till date.
In the first case, deceased son of the complainant had gone on some labour work when he came under cross firing in between security forces and the militants in the year 2005. A very unfortunate and noticing aspect of the case was that the deceased was declared a Pakistani militant Kari Usman. Later, on the application of the father, dead body was exhumed, which was identified as Bashir Ahmad and not the Pakistani militant Kari Usman. The NOKs of the deceased were not provided succor within the ambit of SRO-43.
In other case, daughter of the complainant was abducted by the militants for forcible marriage on 3-4-2000. The militants who had abducted her, were killed by the security forces but whereabouts of Mumtaz Banoo were not known and not her dead body was found. The NOKs of the girl were not provided succor within the ambit of SRO-43, though law presumes that if a person is not seen by any body for continuous seven years, he/she is presumed to be dead.
While disposing off these matters, SHRC Member Jung Bahadur Singh Jamwal recommended to the Government of J&K that the NOKs in both the cases be provided Rs five lakh each in lieu of the Government Order No.893-GAD of 2008 dated 4-7-2008.
