Candidates belonging to economically weaker sections not covered under the reservation rules which are applicable at central level and claiming benefits of reservation under EWS category in UT of Jammu and Kashmir are reported to be facing difficulties in getting requisite income and assets certificates from the Notified Authorities. The reasons, though not specific, could be primarily due to the insufficient knowledge about the requisite amendments to the constitution in 2019 which inter-alia, deal with the reservation issue of 10 percent without touching other categories already covered under reservation, to such categories. The General Administration Department, however, has duly taken note of this non adherence of rules in this regard and impressed upon the Notified Authorities to issue such certificates without fail in order that the beneficiaries could avail the benefits under the Central Government.
These certificates issued to these categories in prescribed formats are mandatory for them to apply for jobs in the Central Government and seek admission to institutions in Government of India. However, it may be noted that the Government order clarifies that persons who are covered under the existing scheme of reservation at the central level are not entitled to claiming benefits under the EWS category. We urge the authorities that necessary certificates must be issued to bona-fide persons falling under the category of EWS so that they are not made to face difficulties and deprived of the benefits under reservation.
