JAMMU, Dec 24: In a Public Interest Litigation (PIL) regarding illegal constructions in Katra, Division Bench of State High Court comprising Chief Justice MM Kumar and Justice Dhiraj Singh Thakur today directed Katra Development Authority to take effective steps in terms of the directions already issued to remove the illegal constructions without entering into any formal notice etc.
When the PIL came-up for hearing, Division Bench observed, “as per the earlier order, reply on behalf of Deputy Commissioner, Reasi has been filed denying any illegal construction being raised on the sealed buildings”.
“Advocate Ajay Sharma appearing for the petitioner requests for some time to file counter to the reply clarifying the actual position as such time is granted for doing the needful before the next date of hearing”, DB said.
In the meanwhile, it was brought to the notice of court through an application filed through Senior Advocate LK Sharma that one Bashir Ahmed, son of Saraj Din, resident of Kun Drorian Katra is raising construction illegally as is depicted in the photographs. He further submitted that Katra Development Authority is maintaining blissful silence.
AAG Seema Shekhar appearing for the KDA stated that after receipt of the application on 16.12.2014, she has asked the Katra Development Authority to file the status report. Upon this, Division Bench directed that the report be filed before the adjourned date with a copy in advance to the counsel opposite. The DB further directed Katra Development Authority to take effective steps in terms of the directions already issued to remove the illegal constructions without entering into any formal notice etc.
