JAMMU, Mar 8: Jammu and Kashmir State Judicial Academy today conducted one day refresher course for Munsiffs of Jammu province on civil and criminal laws at Judicial Academy under the guidance and patronage of Chief patron of State Judicial Academy, Justice N. Paul Vasanthakumar, Chief Justice, High Court of Jammu and Kashmir and Committee of Judges, State Judicial Academy (Justice Muzaffar Hussain Attar, Chairman and Justice Hasnain Masoodi, Member),
Justice (Retd.) O.P. Sharma was the resource person. The programme was conducted by Pawan Dev Kotwal, Director, State Judicial Academy. In his introductory remarks, Director, State Judicial Academy deliberated on the need for such refresher programmes for the Judicial Officers.
Session-I was on the topic “Sections 17, 18, 26, 28, 29, 35, 35-A, 35-B, 45 and 46 of the Code of Civil Procedure”, Session-II relates to “Sections of the Code of Civil Procedure”, and Session-III was on the topic “Sections 3, 4, 8 & 9 of the Evidence Act.”
Justice Sharma dealt with all the topics of the programme. He exhaustively explained the provisions of Sections 17, 18, 26, 28, 29, 35, 35-A, 35-B, 45 and 46, 47, 48, 58 to 60 of the Code of Civil Procedure and their practical application in the first two sessions i.e. jurisdiction of civil courts, institution of suit, service of summons outside the State, imposition of costs, execution of decree and various questions to be determined by the executing court.
In the last session, the resource person dealt with Section 3, 4, 8 & 9 of the Evidence Act and enlightened the participants as regards presumption as to the relevant facts, relevance of motive, preparation and previous or subsequent conduct of parties and test identification parade.
Justice Sharma by his long and varied experience enlightened the participants regarding ways and means which they can adopt while dealing with cases and reminded the Magistrates about their powers, duties and responsibilities in dispensation of justice. He exhorted the Judicial Officers to follow the procedural law in letter and spirit.
