Provide facilities as per provisions of Jail Manual to inmates: DB

JAMMU, Nov 30: In a Public Interest Litigation (PIL) seeking farming of new Jail Manual for J&K and improving condition of inmates, Division Bench of Jammu & Kashmir and Ladakh High Court comprising Chief Justice Ali Mohammad Magrey and Justice Sanjay Dhar has directed that the directions contained in the judgment passed by this court as also by the Supreme Court dealing with the management of the jails be implemented in letter and spirit. The DB further directed the respondents to ensure that the facilities available under the provisions of the Jail Manual are provided to the inmates.
When the PIL came-up for hearing, DB, on perusal of compliance report, observed, “Home Department has already notified Jail Manual in terms of SO 381 dated 17.08.2022 and the Training Manual in terms of SO 382 dated 17.08.2022”, adding “Director General Prisons, has also filed affidavit in tune with the policy and the scheme of the Government”.
“Union Territory of Ladakh, through AIG Personal, has also filed response, providing details qua notifying the Jail Manual and has also provided details of the facilities given to the inmates in the Union Territory of Ladakh”, the DB said, adding “the object for which these PILs were entertained has been achieved and the directions passed from time to time have been implemented”.
“In that view of the matter, there is no need to continue with these PILs, as such, same shall stand closed, however, the respondents are directed to ensure that the facilities available under the provisions of the Jail Manual are provided to the inmates. It is also directed that the directions contained in the judgment passed by this court as also by the Supreme Court dealing with the management of the jails for providing basic facilities to the inmates be also implemented in letter and spirit”.
