JAMMU, Apr 19: In the much publicized Gair Mumkin Khad case, Commissioner/ Secretary to Government, PHE, Irrigation and Flood Control Department appeared before the Division Bench of State High Court and tendered unconditional apology for not being present in the court yesterday.
However, the Division Bench directed him to appear on next date of hearing with concrete measures taken towards framing of Water Policy under Section 4 of J&K Water Resources (Regulation and Management) Act, 2010.
When the case came up for hearing, Advocates A K Sawhney and Aseem Sawhney appeared for the contempt petitioner Rattan Parkash and submitted that the High Court had passed a judgment on February 12, 2016 directing the State Government including the contemner Sourab Bhagat and others to frame Water Policy within two months.
“More than one year has lapsed but the State has not complied with the order of the High Court and is delaying the same on one pretext or the other”, they said, adding “the court had directed the Commissioner/ Secretary to Government Sourabh Bhagat to appear before it but his counsel had submitted that the officer was in Delhi”.
However, on the directions of the Division Bench the Commissioner/Secretary appeared before the court and filed unconditional apology for not being present tomorrow despite being in Jammu.
