JAMMU, Dec 10: Judicial Magistrate, First Class Kathua, Renu Dogra today awarded one year imprisonment and fine of Rs.2000 to one driver Dharm Singh son of Gurdev Singh R/o Sarhandh city Fateh Ghar Punjab facing trial for causing a death of one pedestrian due to his rash & negligent driving.
Brief facts of the case are that on April 8, 2007 Police Station Kathua received an information through reliable sources that one TATA Sumo bearing registration No.1781/CH02 which was being driven by its driver Dharm Singh who was coming from Jammu towards Lakhanpur at about 9:45 pm when reached near Kalibari National Highway lost his control over the vehicle and hit one pedestrian Santosh Gupta wife of Kishori Lal Gupta R/o Kathua who later succumbed to her injuries.
A case FIR under Section 279/304-A/RPC was registered against him in the Police Station, Kathua.
After completion of investigation challan was presented in the court of law JMIC Kathua after hearing Senior P.O. R.P Singh appearing for the State and Ld. Counsel for the accused, observed that the prosecution has proved his case beyond reasonable doubt and evidence of eye witnesses is also corroborated by medical evidence. The accused is proved to be guilty and liable to be convicted.
The court awarded simple imprisonment of one year and fine of Rs.2000 for commission of offence U/S 304 A/RPC, simple imprisonment of two months and fine of Rs.1000 for commission of offence U/S 279 RPC.
