Mere participation in selection process doesn’t confer right to appointment: HC

Srinagar, Nov 26: High Court today dismissed the petition of non-selectee challenging the selection of a candidate on the post of Rehbar-e-Taleem (ReT) by stating that mere participation in selection process doesn’t confer right to appointment
Justice Javed Iqbal Wani dismissed the plea of one Sajad Ahmad Bhat challenging the selection of one Fayaz Ahmad Lone on the post in question with the further relief to consider him on the post in question for relaxation of age by 3 months and 4 days, in terms of earlier notification.
Justice Iqbal recorded that when a post is advertised for recruitment the only right, which a candidate desirous of selection and appointment against the said post has the right of participation and equal consideration. “The rules of recruitment may permit preferential treatment to a candidate based on higher qualification or other valid grounds but, that does not mean that it confers a right to be selected and appointed irrespective of other relevant considerations”, reads the judgment.
Court said that admittedly, the petitioner-Bhat was lacking eligibility at the time of issuance of initial advertisement notice and the respondents thus while issuing subsequent advertisement notice followed the mandate provided in the scheme by extending the zone of consideration for having selection and appointment of most meritorious candidate but it cannot be said that the petitioner-Bhat has been prejudiced by any sense of imagination upon issuance of said re-advertisement notice.
