HC’s directive on under-trials

JAMMU, Nov 12: State High Court today passed explicit directions to all the Jurisdictional Magistrates, Chief Judicial Magistrates and Sessions Judges on the cases relating to under-trial prisoners.
Through these directions, the Judges and Magistrates have been directed to explicitly follow the directions passed by the Supreme Court in Vijay Aggarwal Versus Union of India and Others order on September 5, 2014.
According to the circular issued by Suresh Kumar Sharma, Registrar General of State High Court, all the Jurisdictional Magistrates, Chief Judicial Magistrates and Sessions Judges have been directed to hold one sitting in a week in each prison for two months and identify cases of those under-trial prisoners, who have completed half period of maximum period or maximum period of imprisonment provided for the offence under law.
They have further been directed to pass an appropriate order in the jail itself for release of such under-trial prisoners after complying with the procedure prescribed under Section 436-A of the CrPC (Central) and submit the report of each such sitting to Registrar General, who will submit the report to the Secretary General of the Supreme Court at the end of two months.
According to the circular, the report shall be submitted on or before November 30 apart from the weekly report as ordered by the Supreme Court.
