HC summons IO with CD before court in Parra’s case

Srinagar, Feb 7: High Court directed for the presence of the Investigating Officer (IO) along with case diary of FIR registered against the Peoples Democratic Party (PDP) youth president Wahid-ur-Rehman Parra before the court on February 14.
It is noted that Parra’s counsel had expressed urgency expressed in the case and the court on last date had directed listing of the appeal of Parra for today for its consideration. Since the court is working through virtual mode and the court directed the parties to appear in the matter physically on February 14. ”
“In the event the Court is still working through virtual mode on the said date, both the counsels shall be allowed to enter the Court premises on the said date for physical hearing. The respondents shall also file the health status report of the applicant before the Registry during the course of the week”, Division Bench of Justice Ali Mohammad Magrey and Justice Vinod Chatterji Koul directed.
Parra is facing trial and charges in FIR No. 31/2020 registered against him under section 13, 17, 18, 39, 40 of Unlawful Activities Act read with section 120-B, 121, 121-A, and 124-A of Indian Penal Code and the investigation under the said FIR was taken over by the National Investigating Agency and the petitioner was arrested in the said case in November 2020.
The FIR 31/2020 reveals that some political functionaries are misusing their membership of position in and or have affiliation with political parties as part of a criminal conspiracy, established clandestine connections and relations with different Pakistani supported terrorist and secessionist organizations operating in J&K.
It is also mentioned in the FIR that taking advantage of the cover available because of their membership of position in and affiliation with political parties and attendant superior political, administrative, social influence associated with such membership, position and affiliation, these unscrupulous political party functionaries have variously supported the terrorist and secessionists directly and sometimes through middlemen by way of paying money, organizing select physical attacks through terrorist elements.
