HC stays transfer of JEs

JAMMU, Aug 19: High Court has kept in abeyance the Government order whereby transfer of Junior Engineers in Irrigation and Flood Control Department was ordered.
The order was passed in a petition filed by Naresh Sawhney, Suresh Sethi, Rajesh Sharma, Ravi Kant Sharma and Harpal Singh with the prayer to restrain the respondents from implementing the Government Order No. 243-PW (Hyd) of 2016 dated 05.08.2016 in respect of the petitioners.
During the course of hearing, Advocate Abhinav Sharma appearing for the petitioners submitted that on 12.07.2016, a meeting was called by respondent, which was attended among others by petitioners as well as President, Vice President and Executive Members of the Engineers Association.
“In the meeting the Executive Engineer demanded that the Association should withdraw the complaint alleging malpractice by Executive Engineer and when the Association refused to do so, Executive Engineer got infuriated and started abusing and threatening the members / office bearers of the Association with dire consequences”, the counsel for the petitioners submitted, adding “the Executive Engineer even threatened the petitioners to implicate them in false and frivolous criminal cases”.
After hearing Advocate Abhinav Sharma, First Puisine Judge, Justice Ramalingam Sudhakar issued notice to the respondents and kept in abeyance Order No. 243-PW (Hyd) of 2016 dated 05.08.2016 in respect of the petitioners.
