JAMMU, Mar 12: In a significant order, High Court today stayed the selection of 769 Medical Officers in the Health and Medical Education Department.
The order was passed in a petition filed by Dr Naved Anjum Qureshi and others challenging the selection list issued by PSC vide Notification No 1-PSC (DR-S) of 2014 dated February 25, 2014.
The petitioners challenged Rule 51 of the Jammu & Kashmir Public Service Commission (Business & Procedure) Rules, 1980 as substituted vide Notification No PSC/EX/11/44 dated March 30, 2014 for being ultra-virus the Constitution of India and violative of Articles 14 and 16 of Constitution of India.
They sought direction to the respondents to carry out selection for the posts of Medical Officers in the Health & Medical Education Department pursuant to the advertisement Notification No 16-PSC (DR-P) of 2013 dated August 17, 2013 after revising/revisiting Rules 51 so that all the candidates desirous of serving the State Government as Medical Officers are provided with an equal opportunity.
After hearing Advocate Veenu Gupta for the petitioner, Justice Tashi Rabstan issued notice to Commissioner Secretary Health, PSC through its Registrar, Chairman PSC and Controller of Examination PSC returnable within two weeks. In the meanwhile, subject to objections from other side the impugned order dated February 25, 2014 shall remain stayed.
