JAMMU, Dec 10: High Court has restrained the Government from finalizing the process for selection of insurance company for the implementation of Ayushman Bharat-Pradhan Mantri Jan Arogya Yojana and Ayushman Bharat PMJAY-SEHAT.
The direction has been passed in a petition filed by Universal Sompo General Insurance Company which through Senior Advocate Pranav Kohli and Advocate Arun Dev Singh assailed the order dated December 7, 2021 rejecting the technical bid for selection of insurance company.
The counsels for the petitioner submitted that the petitioner fulfils the eligibility and qualification criteria for bidders as given in the Request for Proposal Clause 3.2.1 of the Qualification Criteria. However, the technical bid has been rejected on the basis of format: Qual-6—checklist for submission of qualification bid, which has added health insurance policies/schemes sponsored by the Central or State Government in Point No.7
“This apparently is not included in the Qualification Criteria. It appears that the checklist only provides for documents required to be submitted and cannot travel beyond the scope of eligibility and qualification criteria by adding any other condition”, Justice Sindhu Sharma observed, adding “prima facie case for indulgence is made out”.
Accordingly, High Court issued notice and said, “in the meanwhile, subject to objections and till next date of hearing, the respondents shall proceed with tender proceedings but the same shall not be finalized”.
