HC directs stopping of Comm RD’s salary

Srinagar, May 27:  Jammu and Kashmir High Court today directed Government to stop the salary of Commissioner Secretary Rural Development Department from the month of June onwards in case he fails to submit compliance to the final judgment of the court.
Justice Ali Mohammad Magrey in a contempt petition observed that the final judgment has not been complied with in letter and spirit by the Commissioner Secretary Rural Development Department. It directed Government to stop his salary in default of submitting compliance report before the court with regard to compliance of judgment.
“In case Commissioner Secretary Rural Development Department fails to submit compliance of orders he shall not draw his salary for the month of June 2015, onwards”, court directed.
Court observed that the instant contempt petition has remained on board for the last three years and respondents have time and again sought time to file compliance as court has adopted ‘liberal approach’ and granted opportunity from time and again.
Court in its final judgment had directed the officials to treat the petitioner as panchayat supervisor cadre against which post he is holding the lien and settle his seniority in the said service and provide him consequential benefits promotions as are entitled to him under the service rules.
Respondents while implementing the judgment partially as fixed the seniority of the petitioner and did not release the further consequential benefits and promotions as they were directed in the judgment. Petitioners counsel submitted before the court that petitioner has suffered a lot on account of non-implementation of final judgment as he has retired from services.
Court with these submissions of the petitioners counsel directed the Commissioner Secretary to file a detailed affidavit before the court specifying therein response to the observations made in the order with reference to implementation.
