SRINAGAR, Apr 5: Jammu and Kashmir High Court today directed the Director Department of Food, Civil Supplies and Consumer Affairs Kashmir to release the salary of its employees by next date or appear in person before the court.
The direction has been passed in an application filed by 16 employees of the department posted in Kargil alleging that they are harassed on one pretext or other by the higher officials and on that count their salary has been withheld despite rendering their services in the department.
“In the meanwhile, respondent-2 Director, CA&PD shall ensure release of salary in favour of the applicants as requisitioned by the Financial Advisor, failing which the Director shall appear in person on April 10”, Justice Ali Mohammad Magrey directed the appearing counsel for petitioners advocate S R Hussain.
Counsel appearing for applicants submitted that the applicants have been promoted in terms of the judgment passed by this court. However the respondents have in order to settle scores with the applicants started harassing them in different ways including rescinding transfers orders which compelled the applicants to file instant application.
In terms of the order passed on 22.6.16 this court while issuing notice to other side, had stayed the order dated 13.6.16 passed by the Director, therefore restoring their position with reference to their posting prior to the order passed on 13.6.16.
Counsel for the applicants submitted that despite petitioners having rendered their services at respective places but have not been paid their salary. Counsel also invited attention of the court to a communication addressed by Financial Advisor department of Civil Supplies and Consumer Affairs department to the Director of Food, Civil Supplies and Consumer Affairs, Kashmir wherein asking him to release the salary of Tehsil Supplies Officers (TSOs) posted in District Kargil out of sanctioned strength of Tehsil supply Officers of Kashmir Division and keep the amount at the disposal of Assistant Director Kargil for the purpose of drawl of salary.
