DB sets aside sentence awarded by trial court, acquits 2

JAMMU, July 17: Division Bench of State High Court comprising Justice Mohd Yaqoob Mir and Justice Janak Raj Kotwal has set-aside the sentence awarded by the trial court to two accused booked under NDPSA and acquitted them.
The trial court had awarded 20 years rigorous imprisonment and fine of Rs 2 lakh to both the accused namely Ghulam Mohd Bhat, son of Haji Mohd Ismaiel of Baramulla and Feroz, son of Jamil Ahmad Ansari of Mumbai, who were booked by Batote Police on April 23, 2009 under NDPSA.
The judgment of the trial court was challenged in the High Court and Division Bench comprising Justice Mohammad Yaqoob Mir and Justice Janak Raj Kotwal observed, “in totality of the facts, circumstances and law it can be safely concluded that the prosecution has failed to prove case beyond doubt”.
With these observations, DB set-aside the sentence awarded by the trial court and acquitted both the accused.
