JAMMU, Sept 15: Division Bench of the State High Court comprising Justice Dhiraj Singh Thakur and Justice Janak Raj Kotwal today issued notices to Commissioner Secretary GAD, Director State Vigilance Organization, Sheikh Owais Ahmed, former Director Vigilance, AIG (Hqrs) SVO and SSP (PR) in a PIL filed by social activist Prof S K Bhalla alleging hushing up of Rajouri Development Authority scam.
After hearing Advocate SS Ahmed appearing for the petitioner, the Division Bench in the open court issued notices to the state functionaries, which were accepted by AAG Ehsan Mirza vice AAG P C Sharma for SVO and Advocate Ahtsham Bhat accepted notice on behalf of Commissioner Secretary GAD.
Advocate Ahmed submitted that on March 26, 2015 the then Director Vigilance Sheikh Owais Ahmed had approved registration of formal case against the suspect public servants for indepth investigation and also issued directions to the SSP (PR) to furnish draft FIR to the central office. However, the Director Vigilance on June, 10, 2015 wrote a communication to the Commissioner Secretary GAD whereby the GAD was asked to issue directions to the concerned department to follow codal procedure strictly while executing the works and remain careful in future.
“An established case of loss to State exchequer in which earlier approval for registration of FIR was given and later only recommendation for just a warning to the suspect public servants was issued, is required to be reopened and the whole scam needs to be unearthed under the monitoring of this court”, Advocate Ahmad further said.
In the PIL, it has been alleged that the prime suspect in the scam is Mohammad Javed Khan, the then Chief Executive Officer Rajouri Development Authority.
