JAMMU, July 3: In a Miscellaneous Application highlighting undue security cover to Additional PRO to the then Deputy Chief Minister, Division Bench of the State High Court comprising Justice Tashi Rabstan and Justice Sanjay Kumar Gupta today granted final opportunity of four weeks to Commissioner Secretaries of General Administration and Home Departments for filing their response.
They have been directed to submit action initiated on petitioner’s complaint dated May 9, 2016 seeking initiation of disciplinary proceedings against two IPS officers of J&K cadre namely Atul Goel and Anand Jain for misusing/abusing their official position by providing undue security cover to Kewal Kumar Sharma, Forest Guard turned Additional PRO to the then Deputy Chief Minister.
When the Miscellaneous Petition came up for hearing, Advocate Sheikh Shakeel Ahmed with Advocates Supriya Chouhan and Suraj Singh appearing for the PIL submitted that the State High Court had passed strictures against the former SSPs for providing undue security cover to Kewal Kumar Sharma. “Moreover, Division Bench vide its order dated February 3, 2016 had reserved the liberty to the petitioner to approach the competent authority in the State Government with regard to the initiation of departmental action against the delinquent former SSPs”, he added.
He further submitted that on May 9, 2016 the petitioner approached Chief Secretary and Commissioner Secretaries of GAD and Home Department by lodging a complaint for initiating disciplinary action against two IPS officers. But the officers have not filed their response.
Additional Advocate General LK Moza appearing for the State Government again prayed for some more time to file response and the Division Bench took serious note of the delay on the part of the State Government in filing response.
Finally, DB granted last opportunity of four weeks to Commissioner Secretaries of GAD and Home Department for for filing their response to Miscellaneous Application.
