JAMMU, Apr 7: Division Bench of High Court comprising Chief Justice MM Kumar and Justice Muzaffar Hussain Attar has disposed of a Public Interest Litigation (PIL) filed by one Ranbir Singh Manhas regarding functioning of old Sub-District Hospital Bhaderwah.
When the PIL came-up for consideration, Division Bench observed, “detailed objections have been filed by the State counsel giving details of setting up of the new hospital as per the policy decision taken by the State Government”, adding “new hospital has been constructed on land measuring 38 kanal. It has taken almost seven years to complete the process of construction of the new Sub District Hospital complex and funds to the tune of Rs 1947 lakh have been released by the department to the executing agency up to July 2013”.
“The new building, with all modern facilities, has come up and it would not be feasible to abandon the same. Moreover, to confront the wintery conditions and the inclement weather a centrally heating system has also been installed in the new Sub District Hospital building and in order to keep it functional, adequate funds have been made available. In respect of restoring the patient care facilities in the old hospital building, it has been submitted that OPD and emergency services have been kept alive for the patients round the clock to the extent of providing first aid in the interest of patient care”, the DB further observed.
After considering the submissions made at the Bar by counsel for the parties, the DB said, “the respondent State has made endeavor to broad base the medical facilities for the citizens by constructing a new hospital. Even in the old hospital, OPD and emergency services have been kept alive to the extent of providing first aid to the patients round the clock”, adding ” “we cannot accept the request made by the petitioner that directions be issued for restoring the old Sub-District Hospital Bhaderwah”.
With these observations, Division Bench closed the proceedings in the PIL.
