Srinagar, Mar 5: The trial court has directed the Senior Superintendent of Police to investigate the contentions raised by the complainant for torturing him in police custody.
The Chief Judicial Magistrate said the complaint filed by one Maqsood Hussain Shah with the allegations enumerated and the preliminary statement of the complainant are taken on record. Court said the allegations levelled and in order to decide whether or not there is sufficient ground to proceed further in the matter, it is proper a thoroughly investigation is required and directed the SSP concerned to conduct the investigation in the matter under section 202 of Criminal Procedure Code and submitting the report of investigation by next date.
Complainant-Shah submitted that he was arrested by police in connection with false FIR and was kept in police lock-up for seven days where he was subjected to third degree torture by SDPO-PC Srinagar along with other policemen and thereafter he was taken to Police Station, Chassana where he was kept in custody for 7 to 10 days and was again tortured by the policemen there with third degree treatment.
He adds in the complaint that the SDPO told him that he will be released from the hand cuff before the Munsiff court of Mahore where he is being produced and also told him to flee away from the said court but the complainant-Shah did not flee as he was innocent and on his he was again taken to lockup where he was again assaulted brutally by the policemen stationed there.
It is contended that he was implicated in another FIR on approaching the Anti Corruption Bureau, DGP and other authorities by way of complaint against the SDPO.
The complainant contends in the complaint that the SDPO is hell-bent to implicate him and his relatives in false case and also threatened the complainant to implicate him in frivolous case related to NDPS Act because he has complained before higher authorities against him.
The complaint has been filed against the police officials for commission of offences of causing hurt, disobeying law, false evidence, wrongful confinement and punishment for criminal intimidation to the complainant.
