JAMMU, Feb 3: District Consumer Disputes Redressal Forum has directed South African Airways, Baggage Services Air India Ltd, In Air Holiday Pvt Ltd and M/s Nidheesh Tour and Travels Pvt Ltd to pay compensation to an aggrieved air traveler from Jammu who had lost his baggage on way from Johannesburg and Cape Town to India in 2007.
While disposing of the complaint by one Sanjeev Dev Singh Kanwar of Sainik Colony, the Consumer Forum directed the OPs to pay jointly the sum of rupees in Indian currency equivalent to 840 USD besides Rs 10 thousand compensation for causing mental torture to complainant and a sum of Rs 5000 quantified towards litigation charges.
The OPs shall comply the order jointly within one week and deposit the amount in the Forum, which shall be paid to the complainant through payees account cheque.
In the complaint, Mr Kanwar submitted that he visited South Africa on an incentive trip by Maruti Udyog Ltd in 2007. He returned back to India by Flight number SA, 0284. However, after reaching Mumbai his baggage was not found after which he lodged complaint with Baggage Service Air India Ltd. The South African Airway and Baggage Services Air India Ltd assured the complainant that baggage would be delivered at Jammu address of their agent namely M/s Nidesh Tour and Travels. On this assurance, the complainant approach Nidheesh Tour and Travels in Jammu to collect the lost bag but was surprised to see locks of his bag broken and article found stolen.
According to the complainant, total value of lost items was USD 840.
