Cheat awarded imprisonment for committing fraud

JAMMU, Sept 28: The Additional Sessions Judge (Anti Corruption) Jammu convicted Rajinder Kumar alias Shinda of Vikas Nagar, Talab Tillo Jammu in a case of fraud and cheating.
He has been sentenced for simple imprisonment of three years, each for the commission of the offences under section 420/468 RPC and for a term of five years each for offences under section 467/471 RPC and shall also pay a cumulative fine of Rs one lakh for all the offences.
A case FIR number 02/2007, under section 420/467/468/471/120-B RPC, R/W section 5(2) Prevention of Corruption Act Svt 2006 was registered against the accused in Police Station Crime Branch, Jammu.
The brief facts of the case are that a written complaint was lodged by Mangat Ram of Chumbian Samba who had purchased a Bus bearing number JKQ-5349 in October-1988, in partnership with one Kaka Ram. There business did not turn out to be profitable. As such, he sold the said bus in June 1989 to a party hailing from UP and the Route Permit of the said vehicle was deposited with RTO, Jammu. In the year 1991, Rajinder Kumar alias Shinda, son of Dewan Chand of Vikas Nagar Talab Tillo, Jammu approached Mangat Ram along with one Jai Singh alias Raja Dalal, for the purpose of above said Route Permit. The deal was struck, and he was made to sign various forms and documents brought to him by the said Rajinder Kumar. His passport size photograph was also taken by Rajinder Kumar, on the pretext of transfer of said route permit.
However, after a gap of 13 years, Mangat Ram received a letter from J&K State Financial Corporation on 17.04.2004, whereby he was asked to pay an amount of Rs 15,49,495 on account of a loan for vehicle number JK02B-2174, registered in his name which he had never purchased or owned. On this instant case was registered in PS Crime Branch, Jammu.
After completion of investigation, the charge sheet in the instant case was produced in the Court of Law on 23.04.2013 against the accused Rajinder Kumar alias Shinda and five others.
