Bail denied in rape case

JAMMU, July 25: 3rd Additional Sessions Judge Jammu Subash C Gupta has denied bail to a resident of Gujjar Nagar, who has been booked by the Gandhi Nagar Police for allegedly committing rape with a girl.
After hearing Advocates R K Kotwal and Mandeep Singh for accused Arif Choudhary, son of Shah Din of Gujjar Nagar and Additional Public Prosecutor for the State, the court observed, “on perusal and consideration of the documents relating police report submitted in terms of Section 173 of Code of Criminal Procedure and on the basis of the charge framed against the accused, an inference can safely be drawn that accusation against him appears to be prima-facie true”.
“The applicant is not entitled to be released on bail as there is a specific bar contained in the proviso to Section 497-C of the Code of Criminal Procedure”, the court said, adding “moreover, there is an increase in graph of crimes against women and in the present matter gravity, heinous and seriousness of the crime committed against the girl can safely be kept in the category of referred offences”.
The court further said, “in order to repose confidence and trust among the common masses in the administration of justice more particularly in the judicial system of the country and State of Jammu and Kashmir, rejection of bail application of the accused is needed”.
With these observations, court rejected the bail application of the accused.
