Bail denied to accused involved in attack on police party

JAMMU, Oct 23: Additional Sessions Judge Jammu S L Lalhal has rejected the bail application of Sunil Kumar, son of Janak Raj and Gagan Kumar, son of Karam Chand of Bhagatpur Ghou Mansha, who were allegedly involved in attack on police party on August 20, 2018 in an area under the jurisdiction of Police Post Poni Chak.
After hearing Advocate Deepika Singh Rajawat appearing for the applicant, the court observed, “the perusal of the case diary and police report reveals that accused have committed offences under Sections 307, 353, 382, 332, 147, 148 & 120-B RPC & 4/25 Arms Act”, adding “the present applicants/accused are absconding after the commission of alleged offences and the weapons of offences are yet to be recovered from them”.
The court further observed, “the offences committed by the accused are heinous in nature and if the present applicants/accused are admitted to bail, the recovery of the weapons of offence may not be affected and thus, the investigation of the case may be scuttled”.
With these observations, court rejected the bail application.
